Changes to a new Santa Cruz County septic system ordinance was approved by the Santa Cruz County Board of Supervisors, creating a series of requirements that seek to bring the county into compliance with state and local mandates..

This Point-of-Sale Disclaimer Document  has been finalized and will be required for all real estate transactions for parcels that are served by an onsite wastewater treatment system (OWTS) beginning July 1, 2023.  This applies to all transactions that close on or after July 1, 2023. 23. 

If repairs are identified on the sales inspection report submitted by the liquid waste hauler, the buyer and seller may jointly agree to a Transfer of Responsibility

Things to note:

  • The liquid waste hauler pumping inspection reports must be performed within the preceding 6-month period prior to the date of the transaction.
  • The pumping inspection report must be performed by a liquid waste hauler with a valid Health Permit and who is authorized to pump and inspect septic tanks. Please find a current list of providers here.
  • The Disclosure and the Transfer of Responsibility forms must be submitted to Environmental Health by email to ENVPointofSale@santacruzcounty.us

Specific qualifications and licenses are required to design, construct, maintain, repair and/or replacement of an Onsite Wastewater Treatment Systems (OWTS) in Santa Cruz County. Environmental Health (EH) has a certification program for Online System Service Providers (OSSP) and a registration program for liquid waste haulers.
